Terms of Service

1. Welcome to Pin Pal Studio

Pin Pal Studio is an AI-assisted Pinterest workspace operated by Julie Burns at This Girl Shines. By registering for and using Pin Pal Studio, you agree to these terms. They exist to set clear expectations for both you and us, and to comply with Australian law.

In these Terms, "Pin Pal Studio," "we," "us," and "our" refer to the service operated by Julie Burns trading as This Girl Shines. "You" refers to you, the user of the service.

2. What Pin Pal Studio Does (and Doesn't Do)

Pin Pal Studio helps you draft, review, and publish content to Pinterest. Specifically:

• We use AI (via your own OpenAI API key) to draft pin titles, descriptions, alt text, and images based on your brand profile and content library.
• You review and approve every pin before it publishes. Pin Pal Studio does not autonomously publish content to Pinterest.
• We provide trend discovery, scheduling, and improvement recommendations to help your Pinterest activity perform well.

What Pin Pal Studio does not do:

• We do not guarantee specific results on Pinterest (reach, saves, click-throughs, traffic, revenue). Pinterest's algorithm and audience response depend on factors beyond any tool.
• We do not handle the relationship between you and Pinterest. Your Pinterest account is yours; Pinterest's terms of service apply.
• We do not manage your OpenAI account or your OpenAI billing. You have a direct relationship with OpenAI for AI usage.

3. Eligibility and Account Registration

To use Pin Pal Studio, you must:

• Be at least 18 years old, or the age of majority in your jurisdiction.
• Be authorised to enter into these Terms on behalf of yourself or any business you represent.
• Provide accurate registration information and keep your account details up to date.
• Have or create a Pinterest Business account (Pinterest's terms apply to that account).
• Have or create an OpenAI account, with an API key and payment method on OpenAI's side, if you wish to use AI features.

You are responsible for keeping your account credentials secure. Notify us promptly at hello@pinpalstudio.au if you believe your account has been compromised.

4. Your Responsibilities as a User

By using Pin Pal Studio, you agree to:

• Provide accurate information in your brand profile and content library. Inaccurate information may cause AI-generated content to misrepresent your brand.
• Review and approve every pin before it publishes to Pinterest. Pin Pal Studio gives you the tools to review; the responsibility for what gets published is yours.
• Comply with Pinterest's terms of service in everything you publish through Pin Pal Studio. Pinterest's rules on spam, copyright, content quality, and advertising apply to pins you publish.
• Not use Pin Pal Studio for illegal, harmful, or abusive content, including content that infringes copyright, violates privacy, promotes hate, or otherwise breaches Australian law.
• Use only content you have the right to use in your Content Library. Articles, blogs, products, images, and other source material you import must be yours, properly licensed, or fall under fair dealing exceptions.
• Comply with OpenAI's usage policies when using AI features through your OpenAI key. Violations of OpenAI's policies are between you and OpenAI.
• Maintain your own OpenAI account in good standing. Pin Pal Studio cannot generate AI content if your OpenAI key is invalid, your account has no credit, or your account has been suspended by OpenAI.

We reserve the right to suspend or terminate accounts that violate these terms, subject to your rights under Australian Consumer Law.

5. AI-Generated Content

Pin Pal Studio uses AI to generate pin drafts on your behalf. The following describes how we treat that content, and important limitations you should know about.

How AI-generated content is produced for you

Pin drafts created through Pin Pal Studio's AI features are produced for your use under your subscription. You may edit, publish, delete, or otherwise use them within the scope of your Pin Pal Studio account and your own Pinterest account.

• Pin Pal Studio does not claim ownership of AI-generated content created on your behalf.
• We do not use your brand profile, content library, pin drafts, or approved pins to train AI models — ours or anyone else's.

Important limitations of AI-generated content

• The legal status of ownership and copyright of AI-generated content is unsettled in Australia and internationally. You should not rely on Pin Pal Studio's AI-generated content as independently copyrightable. If your use case requires guaranteed copyright protection (for example, content you intend to license commercially to others), you should seek your own legal advice.
• AI may produce inaccurate, biased, or off-brand output. That is why human review is built into every pin's path to publishing. You bear final responsibility for what you publish.
• AI-generated content may inadvertently resemble existing copyrighted works. Pin Pal Studio takes reasonable steps to prompt the AI in ways that avoid this, but cannot guarantee originality. If you publish AI-generated content that infringes another party's rights, that is your responsibility.
• Pinterest's policies on AI-generated content apply. Pinterest currently allows AI-generated pins but may apply an "AI modified" disclosure tag to them. Pin Pal Studio publishes pins via Pinterest's API; Pinterest's automated systems determine whether such tags are applied.

Our licence to operate

You grant Pin Pal Studio a limited, non-exclusive licence to process the content you provide (brand profile, content library, pin drafts) solely for the purpose of providing the service to you. This licence ends when you delete the content or your account.

6. Pinterest Account Safety

Pin Pal Studio is designed to publish in patterns that match how Pinterest rewards consistent, steady publishing. We do this through:

• Pacing of approved pins across the day and week
• Volumetric daily caps
• Time-of-day publishing windows
• Duplicate URL cooldowns

However:

• We cannot guarantee that your Pinterest account will not be suspended, restricted, or flagged. Pinterest's algorithm and policies are not under our control, and Pinterest can take action on accounts for reasons we cannot anticipate or prevent.
• You are responsible for the content you publish. If you approve pins that violate Pinterest's terms, Pinterest may act on your account.
• We are not liable for Pinterest's actions on your account, including suspension, restriction, or content removal.

7. BYOK — Your OpenAI Account

Pin Pal Studio uses "Bring Your Own Key" (BYOK) for AI features. This means:

• You connect Pin Pal Studio to your own OpenAI account using an API key.
• OpenAI charges you directly for AI usage. Pin Pal Studio does not mark up AI costs or process AI charges on your behalf.
• We provide an in-app estimate of your image-generation usage as a convenience, but the authoritative billing comes from OpenAI's own dashboard.
• You are responsible for setting a spend cap on your OpenAI account if you wish to limit AI charges. We recommend setting one and provide a link to OpenAI's spend-cap page in the setup wizard.
• If your OpenAI key becomes invalid, your OpenAI account runs out of credit, or OpenAI suspends your account, AI features in Pin Pal Studio will stop working until you resolve the issue with OpenAI.

We are not party to your relationship with OpenAI. OpenAI's terms of service and privacy policy apply to that relationship separately.

8. Subscriptions, Payments, and Refunds

Subscription terms

• Pin Pal Studio offers monthly subscriptions only — no annual plans, no free trial.
• Subscriptions are billed in advance each month via Stripe.
• You can cancel at any time from your account settings. No phone calls, no retention forms.

Refunds

• Subscription fees are generally non-refundable once a billing period has begun.
• Cancellation takes effect at the end of your current billing period — you retain access for what you have paid for, and are not charged again.

Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies your rights under Australian Consumer Law (the Competition and Consumer Act 2010). You have consumer guarantees that apply automatically, including (among others) guarantees that the service will be provided with due care and skill and will be fit for any particular purpose made known to us.

If we fail to meet a consumer guarantee, you may be entitled to a refund, a re-supply of the service, or compensation for foreseeable loss or damage, as required by Australian Consumer Law.

Pricing changes

We may change subscription prices with at least 30 days' notice by email to your registered address. Price changes take effect at your next billing period after the notice period. You may cancel before the new price takes effect if you do not wish to continue.

9. Intellectual Property — Pin Pal Studio's Materials

The Pin Pal Studio platform itself — its software, design, written guidance, prompts, illustrations, mascot character ("Lumi"), and brand materials — is the intellectual property of Julie Burns / This Girl Shines.

• Your subscription grants a personal, non-exclusive licence to use Pin Pal Studio within the service.
• You may not copy, modify, redistribute, or resell Pin Pal Studio's software, branding, or materials without a separate written commercial licence.
• This does not affect treatment of pin content you create (see Section 5), only the platform itself.

10. Disclaimers

To the fullest extent permitted by law, but subject to your rights under Australian Consumer Law (Section 8):

• Pin Pal Studio is provided "as is." We do not guarantee that the service will be uninterrupted, error-free, or that all features will work in all circumstances.
• We do not guarantee specific business outcomes — including Pinterest reach, saves, click-throughs, traffic, lead generation, or revenue.
• AI-generated content may be inaccurate, biased, or unsuitable for your needs. The review queue exists so you can catch this; the final responsibility for what you publish is yours.
• Pin Pal Studio is for informational and creative-production purposes. We do not provide professional medical, legal, financial, or marketing advice through the platform.
• Third-party services we integrate with (Pinterest, OpenAI, Google, Stripe) are operated by those third parties under their own terms. We are not responsible for their availability, behaviour, or terms changes.

11. Limitation of Liability

To the fullest extent permitted by law, and subject to your rights under Australian Consumer Law:

• We are not liable for indirect, incidental, consequential, special, or punitive damages arising from your use of Pin Pal Studio, including lost profits, lost data, lost goodwill, or business interruption.
• Our total liability for any claim arising from Pin Pal Studio is limited to the amount you paid us in subscription fees in the 12 months preceding the claim.
• We are not liable for actions taken by Pinterest, OpenAI, Google, Stripe, or any other third-party service provider, including account suspensions or service outages.
• We are not liable for content you choose to publish, including AI-generated content that you have reviewed and approved.

These limits do not apply to liabilities that cannot be excluded under Australian Consumer Law.

12. Suspension and Termination

Termination by you

You can cancel your subscription at any time from your account settings, effective at the end of your current billing period.

You can request full account deletion by emailing hello@pinpalstudio.au. See the Privacy Policy for details on what happens to your data.

Termination by us

We may suspend or terminate your account if:

• You violate these Terms or our Privacy Policy.
• You use Pin Pal Studio for illegal, harmful, or abusive purposes.
• Your OpenAI account, Pinterest account, or payment method becomes unavailable in ways that prevent us from delivering the service.
• We are required to do so by law.

Where reasonable, we will notify you before suspension or termination and give you an opportunity to remedy the issue. Australian Consumer Law rights apply in any case.

13. Changes to These Terms

We may update these Terms as Pin Pal Studio evolves. Material changes will be communicated by email to your registered address and/or by an in-app notice, at least 30 days before they take effect for existing subscribers. Continued use of Pin Pal Studio after the change takes effect indicates acceptance.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland, Australia, subject to your rights under Australian Consumer Law to bring matters in your local jurisdiction.
